55+ Housing FAQ's
A list of frequently asked questions regarding 55+ Communities.
-
If a facility or community registers with FCHR, does that mean it is "certified" as meeting the requirements for the exemption from the act?
FCHR accepts registrations based solely on the written representations of the registrant. The FCHR does not independently determine whether or not the registrant in fact meets the requirements of the law.
-
One umbrella association operates a number of 55 and older mobile home parks, communities or facilities. Must each register separately and pay a fee?
It depends upon whether each facility is a separately declared condominium, cooperative or other real property regime. If each entity under the umbrella association is a separately declared entity recorded in the county where the property is located, then each must pay a fee.
-
What is familial status?
This means families with children.
-
Can a facility's or community's attorney sign the letter of registration?
The law requires that the letter must be signed by the president of the facility or community, on its letterhead stationery.
-
Why does a facility or community have to register with the Florida Commission on Human Relations to claim 55+ status?
A community that is claiming 55+ status is asking to be exempted from the Florida Fair Housing Act as it pertains to familial status. The Florida Legislature requires these communities to register with FCHR by sending a certified letter to the Commission stating that the facility or community is in compliance with the requirements.
-
I am part of a management company. Can I submit payment on behalf of a 55+ community and use my company's address and contact information instead of the community's?
The 55+ housing relationship is between the Commission and the housing community. It is essential that the address and contact information provided is for the community, not the management company. This will expedite matters and simplify the process for everyone.
-
Why do 55+ communities need to register separately and submit payment separately?
The Commission does not charge individual buildings within the same community. Several different communities can be managed by a single management company, but the management company is required to submit separate checks for each community. A combined, lump sum payment in excess of $20 will be returned to the management company or representing entity. Because each of the communities is provided an individual account number, each one must be treated as a separate entity, and separate payments for registrations and/or renewals are required.
